What are the licenses currently issued by the FSSAI?

The FSSAI currently issues licenses to businesses on the basis of their annual turnover. These businesses include, among others, hotels, manufacturers, produces, etc. There are three different licenses in existence, namely,
  • Registration: For Turnover less than Rs. 12 Lakh
  • State License: For Turnover between Rs. 2 Lakh to Rs. 20 Crore

Does the FSSAI investigate claims of food-borne illness and foreign object complaints?

Yes, the FSSAI does investigate any claims that have been brought to it by the general public or any other concerned party. Is an FSSAI license required for businesses?

All business that is into some part of the food supply chain is required to have a valid FSSAI-issued license. In other words, yes. An FSSAI license is required for all businesses that are into food and food products. It is a mandatory requirement for all businesses in the country that is engaged in the manufacture of food and food products, to acquire an FSSAI certificate. Who are the members of the FSSAI and what is the tenure of these members?

There are several different members of the FSSAI. The tenure of the members depends on the individual. The chairperson and members other than those who are ex officio are allowed to hold a term of three year. They are also eligible to hold office for another three years, until the age of 65. This age limit is set to 62 for members. The scientists under this department have tenure of three years as well, just like other members of the panel.

What are the laws that were repealed after the establishment of the FSSAI?

The FSSAI was created to simplify the process of food production. To ensure that the process was made easier to manage, the following set of laws were repealed, or subject to a repeal, namely, The following Acts/Orders mentioned in second schedule of the Act are going to be repealed in Food Safety and Standards Act, 2006:
  • Prevention of Food Adulteration Act, 1954
  • Fruit Products Order, 1955
  • Meat Food Products Order, 1973
  • Vegetable Oil Products (Control) Order, 1947
  • Edible Oils Packaging (Regulation) Order, 1998
  • Solvent Extracted Oil, De oiled Meal, and Edible Flour (Control) Order, 1967
  • Milk and Milk Products Order, 1992
  • Any other order under Essential Commodities Act, 1955 relating to food

What is the liability under the existing rules for problems pertaining to food safety?

The FSSAI is responsible for the safety of public health across the country. This need of FSSAI regulations makes it important for its employees to adhere to the highest standards of responsibility. The penalty for the failure to carry out the responsibilities range to a fine of up to one lakh rupees if found guilty under section 39 of the act. In addition to this, another thing that should be added is that when the complaint is made against the Food Safety Officer, the complainant will be punished with a fine that is not less than fifty thousand and may extend to one lakh rupees.

Does the FSSAI currently have any regulations with regard to GM food or Organic Food?

The term GM or Genetically Modified, is a reference to the fact that its genetics were modified, using various biotechnological advances in science. In the case of food, it can mean that one or several of the ingredients used for the same, were of GM origin. The FSSAI currently has no specific guidelines on the regulation of GM food or food products in the country. This is because the regulation of the same doesn’t come under the regulatory purview of the department. With regard to organic foods, the department has not set any specific standards. The term organic is currently applied to the various ingredients that have been produced based on set by specific standards. Organic foods are currently not regulated by the FSSAI. These two are a lacking need in the FSSAI, which will probably be addressed soon.

Does the FSSAI currently provide any microbiological guidelines with regard to food safety?

There are currently no microbiological guidelines currently in place, in India. Therefore, these concerns do not apply to the FSSAI. At the same time however, FSSAI does provide guidelines for microbiological standards, with regard to food safety.

What laboratory infrastructure does the country have, with regard to the testing of food?

The country has a vast network of laboratories catering to different needs, which includes even food safety.
